Terms of Service
Acceptance of terms
By accessing or using Caelen ("the Service"), you agree to be bound by these Terms of Service and the Privacy Policy. If you are using Caelen on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
About Caelen
Caelen is an independent product, developed and maintained by a single developer, Ömer Sefa Çarıkçı. There is no company behind it — when these terms refer to "we" or "us", they refer to me.
Use of the service
You may use Caelen for lawful purposes only. You agree not to:
- Use the Service to store, share, or transmit illegal or harmful content.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Reverse-engineer, decompile, or otherwise attempt to extract source code.
- Resell, sublicense, or otherwise commercialize access to the Service without written consent.
- Use the Service in a way that degrades performance for other users (e.g., automated scraping).
Accounts & workspaces
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify me immediately through the contact page if you suspect unauthorized access. I am not liable for losses resulting from compromised credentials.
Each workspace owner is responsible for managing member access and ensuring that members comply with these terms.
Billing & payments
- Paid plans are billed monthly or annually in advance. All prices are in USD unless stated otherwise.
- Upgrades take effect immediately and are billed pro-rata. Downgrades take effect at the next renewal date.
- If payment fails, you will be notified and given a 7-day grace period before your workspace is downgraded to the Free plan.
- Refunds are not offered for partial billing periods, except where required by law.
Intellectual property
All intellectual property rights in the Caelen platform — including the software, design, and documentation — belong to Ömer Sefa Çarıkçı. You retain full ownership of all content you create and store within your workspace. By using the Service, you grant a limited license to host and process your content solely to provide the Service.
Service availability
I aim for 99.9% uptime on paid plans. Planned maintenance will be communicated at least 48 hours in advance. I am not liable for downtime caused by third-party infrastructure failures, force majeure events, or factors outside my reasonable control.
Limitation of liability
To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or business interruption. My total liability for any claim arising under these terms shall not exceed the amount you paid in the 12 months preceding the claim.
Termination
You may close your account at any time from your workspace settings. I reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation. Upon termination, your workspace data will be deleted within 30 days.
Governing law
These terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Turkey.
Changes to these terms
These terms may be updated from time to time. You will be notified of material changes at least 14 days before they take effect via email or in-app notification. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
